From the first article:

The top seven floors were demolished to adhere to building codes in 1997. In 1999 the mall burned due to suspected arson committed by a competitor in the area.

So it sat there for 2 years without a roof and was it open to the public or was it vacant?

But the first article also mentioned casualties as a result of the fire which sounds like the mall was in use from 1997-1999 without a roof!!

The disaster resulted in several casualties, and the building has remained abandoned ever since.

No one bothered to put a roof on it?

From what I read in the second article, the mall owner has to bear responsibility for repairs. So the company that did the demolition of the mall, they're demanding payment of 10 million baht ($306,936.77 US) from the owner.
